PURPOSE

The purpose of the Arbor Medicus website is to help adult individuals collect and organize their personal medical history. Individuals voluntarily enter their health information into the Arbor Medicus website, and the website creates an organized health history based on the individual’s entries. Physicians may then be granted permission by their individual patients to access that individual’s de-identified medical information stored on the Arbor Medicus website. I understand that Arbor Medicus ("Program") is a web-based computer program developed and maintained by Arbor Medicus, LLC.

TERMS AND CONDITIONS OF USE

Arbor Medicus, LLC grants limited permission to physicians to access and use ARBOR MEDICUS, a website containing encoded electronic de-identified medical information provided by individuals. Physician’s granted permission by their individual patients to use the Arbor Medicus website agree to be bound by the following Terms and Conditions of use:

1. You agree to use ARBOR MEDICUS solely to access the electronic data files of individuals who have granted you permission to view their health information. This program is designed for use of individuals who are 18 years or older. Individuals using Arbor Medicus have certified that they are 18 years or older before using this website.

2. You agree to access and use ARBOR MEDICUS solely through the use of an individual security code that will be assigned to you by ARBOR MEDICUS upon receipt of authorization by your individual patient. You agree not to share your individual security code with any other individual or allow any other individual to use the website once you have accessed it. If you have reason to suspect that the confidentiality and security of your individual security code may have been compromised, you agree to inform the patient of the breach and be granted a new security certificate by the patient.

3. By using your individual security code to access and use ARBOR MEDICUS, you acknowledge that you may not use, download or print material from ARBOR MEDICUS for any personal, public or commercial purpose, including distributing, selling, using, modifying, or transmitting information contained on ARBOR MEDICUS, without the prior express consent of Arbor Medicus, LLC. You understand you may not change or delete proprietary notices from material downloaded or printed from ARBOR MEDICUS.

4. You understand you may not post or transmit any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, harmful, pornographic or profane material, any proprietary information belonging to others or any material that could be deemed as to encourage criminal activity, give rise to civil liability or otherwise violate the law.

5. You understand and agree that all medical information contained on ARBOR MEDICUS must be held in strict confidence and not accessed or disseminated for any purpose other than for your patients medical care and authorized uses under law, and that violation of this confidentiality may result in a violation of state and/or federal law and may subject you to disciplinary, criminal or civil action. You understand and will comply with all applicable federal, state and local laws governing the disclosure of medical information by providers.

6. You understand that the health and health-related information contained on ARBOR MEDICUS should not be used as a substitute for medical treatment by a health care professional. While every effort is made to ensure the information contained on ARBOR MEDICUS is accurate, complete and timely, Arbor Medicus, LLC does not guarantee the accuracy, completeness or timeliness. You acknowledge that the records in ARBOR MEDICUS are incomplete, and is subject to patient error and omission. You agree to assume total responsibility and risk for your use of this information.

7. You understand that Arbor Medicus, LLC reserves the right to terminate a user’s access to ARBOR MEDICUS, in its sole discretion, at any time, without notice.

8. You understand that Arbor Medicus, LLC may revise these Terms and Conditions at any time. We encourage you to periodically read these Terms and Conditions to see if any changes have been made that may affect you. Your continued use of ARBOR MEDICUS indicates your continued agreement with these Terms and Conditions as they may be revised.

9. You understand that, ARBOR MEDICUS, Arbor Medicus, LLC and its affiliates, suppliers, and other third parties mentioned or linked to on this website are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages (including, without limitation, those resulting from lost profits, lost data, technical problems or business interruption) arising out of or relating in any way to ARBOR MEDICUS content or information contained within ARBOR MEDICUS, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. Your sole remedy for dissatisfaction with ARBOR MEDICUS is to stop using the website.

10) You are responsible for the storage and archiving of any information that you have accessed from this website in compliance with all applicable federal, state and local laws, including without limitation, HIPAA. You will not hold Arbor Medicus or Arbor Medicus, LLC or any of its affiliates responsible for the storage of any information.

11) You understand that the information contained in this website relies on individual self-report. All information reported by the individual should be verified by the clinician and definitive diagnoses be made on clinical grounds, taking into account how well the individual understood the questions, as well as other relevant information.

12) If any provision of this above agreement is held to be void, unenforceable or illegal, then you agree that the agreement will be changed or limited only to the extent necessary to enable the remaining provisions to be of full force and effect.

13) Arbor Medicus and Arbor Medicus, LLC make no warranties or representations of any kind as to the accuracy, currency, or completeness of the information accessed and used through this web site. You agree to the access and use of Arbor Medicus at your own risk. Arbor Medicus and Arbor Medicus, LLC disclaim all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

14) Neither Arbor Medicus or Arbor Medicus, LLC or any party involved in creating, producing, or delivering this program shall be liable for any damages, including without limitation, direct, incidental, consequential, indirect, or punitive damages, arising out of access to, use of or inability to use the Arbor Medicus program, or any errors or omissions in the content thereof. This limitation includes damages to, or for any viruses that infect your computer equipment.
